We will deliver the rental vehicle and equipment free to Christchurch Airport or to hirers Christchurch accomodation at pre-arranged times.

Minimum rental period is 2 days.

All amounts stated are in NZ Dollars. A deposit of 10% is required at the time the booking for confirmationand the balance is due 14 days before start of hire by the following credit/charge cards or cash in $NZ, Visa, Mastercard, American Express.

Following the receipt of deposit we will issue an email or written booking confirmation of hire.

A Bond applies with with EDW (Extra Damage Waiver) is held as a signed credit card voucher over the period of hire.

Personal Accidental Injury - The Accident Compensation Corporation (ACC) administers New Zealand’s accident compensation scheme, which provides personal injury cover for all New Zealand citizens, residents and temporary visitors to New Zealand. In return people do not have the right to sue for personal injury, other than for exemplary damages.

Vehicle Damage Cover: Hirers Liability for Damage - We expect the vehicle to be returned to us at the end of the hire period in the condition it left and the maximum liability of the hirer is as shown on the Table below. If the vehicle is returned in a damaged condition the hirer is responsible for cost of repair and loss to the extent of the table below. A bond for that amount is taken by credit card authorisation at time of hire.

Bond - Hirers will provide at time of taking the vehicle a bond by signed credit card authorisation with complete windscreen and headlight glass cover if the Extra Damage Waiver option is taken.

Extra Damage Waiver (EDW) - Hirers may wish to choose the optional Extra Damage Waiver per day which lowers their liability for damage caused to the vehicle during the hire.

Exclusions - All insurance cover is void if the Terms and Conditions of the rental contract are breached and the total damage cost will be the hirer's responsibility.

Subject to the exclusions set out below the hirer and any authorised driver is indemnified to the level of liability waiver choosen on the table in respect of the loss or damage to the vehicle and its accessories and spare parts and any consequential loss of revenue or other expenses of Overland 4WD Rentals Ltd including towing and salvage costs associated with the recovery of the vehicle and spare parts.

Subject to the exclusions set out below, the hirer, and any authorised driver is indemnified to the extent of a pre-determined value in respect of any liability he or she may have for damage to any property (including injury to any animal) belonging to any other person and and arising out of the use of that vehicle.

• A: The driver of the vehicle is under under the influence of alcohol or any drug that affect the ability to to drive the vehicle
• B: The vehicle is in an unsafe or unroadworthy condition that arose during the course of the hire and that caused or contributed to the damage or loss, and the hirer or driver was aware or ought to have been aware of the unsafe or unroadworthy condition of the vehicle
• C: Vehicle is driven in any roverland, speed test, rally or contest
• D: The hirer is not a body corporate or department of state and the vehicle is driven by any person not named in clause 3 of this agreement
• E: The vehicle is driven by any person who at the time when he or she drives the vehicle is disqualified from holding or has never held a drivers license appropriate for that vehicle
• F: The vehicle is wilfully or recklessly damaged by the hirer or any other person named in clause 3 of this agreement or driving the vehicle under the authority of the hirer, or is lost as the result of wilful or reckless behaviour of the hirer or any such person
• G: If the evehicle is operated outside the term of the hire and the agreed extension of that hire

It is agreed between the owner and hirer that Section 11 of the Insurance Law Reform Act 1977 shall apply with respect to the above exclusions as is this clause constituted a a contract of insurance.

Deposit or money paid for advance bookings is liable to a 10% (of total hire cost) fee unless notice of cancellation is given at least 30 days in advance, or the period can be rebooked. Cancellation with less than 14 days notice will forfeit the full cost.

Early return of vehicle does not entitle the hirer to any refund of the unused portion of the rental fee.

Hire Rates are subject to change without notice and we reserve the right to refuse any rental at our discretion.

The vehicle may be driven during the hire period only by the persons named on the agreement. All drivers licences must be produced at the time of vehicle pick up.

No drivers less than 21 years of age allowed. If drivers are age 21 to 25 years of age there will be an additional excess. If drivers are over 25 years and have held a full drivers license for less than 2 years there is an additional excess.

New Zealand recognises a drivers licence of your Country of Origin (in english) or an International Drivers Permit. Overseas dirivers can drive for up to one year with overseas drivers licenses.

All vehicles operate on an unlimited kilometre basis. The Hirer shall pay only for all diesel or petrol fuel for the vehicle. Vehicle will be returned with the same amount of fuel in it as when it was taken on hire. Normally this would be a full fuel tank.

It is expected that the vehicle is returned to Christchurch base of Overland 4WD Rentals Ltd or the pre-arraged drop off location in the same condition as it was when hired.

Vehicles may be returned earlier than the agreed return date but regrettably no refund for unused days will be possible.

If the vehicle is not returned to Christchurch as arranged then a fee will be charged unless pre-arranged. Returns at other towns or cities can be pre-arranged at for a fee.

Extensions of period must be approved at least 2 days before agreed drop-off time.

If for any reason, the reserved vehicle is not available, we reserve the right to substitute a comparable or superior vehicle at no extra cost to the client. This shall not constitute a breach of contract and does not entitle the hirer to any form of refund.

All speeding, speed camera and parking fines, third party damage claims and associated administration costs will be passed on to the hirer.

If accidents are to be reported within 24 hours by telephone or hirer may become totally liable for that repair cost.

In the event the vehicle is supplied with accessories such as ski rack, snow chains, or other equipment the Hirer shall be responsible for correctly fitting and use of the this equipment. Any damage caused to the vehicle, or any other property resulting from the incorrect fitting of accessories shall be the responsibility of the Hirer.

An AA Membership ensuring mechanical assistance at all times covers all vehicles while on all New Zealand roads.

Our vehicles can be used off formed roads but private roads and private property must be respected. Hirers are responsible for retrieval of vehicles back to road access.

Our vehicles are well sealed against water and dust but deep water can cause problems. We recommended a maximum wading depth of 350mm for Land Cruisers and 200mm for RAV4's. Vehicles may not be driven on coastal beaches only with our permission.

Delays caused by breakdowns or weather conditions. Should the hire be delayed for more than 6 hours because of a mechanical breakdown we will refund the hirer one days hire. Should the vehicle be unable to be repaired within 24 hours we reserve the right to substitute the vehicle if one is available or to cancel the hire and refund any unused portion of the hire.
